Terms of Use for Voxavo

1. Scope

These Terms of Use apply to the Voxavo iPhone app by Tom Silas Helmke. Mandatory consumer rights remain unaffected.

2. Using Voxavo

Voxavo is a communication aid for typing and speaking aloud, amplifying your own voice, and saving frequently used phrases. Voxavo is not a medical device, therapy, treatment, diagnostic tool, or a substitute for medical advice or treatment.

3. Responsible volume use

Voice amplification plays audio through your device's speaker. You are responsible for choosing a volume and usage situation that does not unreasonably affect your hearing or the people around you.

4. Voxavo Free and Voxavo Pro

Voxavo Free includes type & speak, voice selection with a sample, speaking speed, Large & Clear, accent colors, and the German and English app interface. Voxavo Pro adds voice amplification, your own phrases, favorites, manual ordering, history, and amplification profiles.

5. Subscriptions and payments

Voxavo Pro is offered as a monthly or annual auto-renewing subscription through Apple StoreKit 2; no lifetime purchase or trial is offered. Billing is handled through your Apple ID under App Store terms. The price shown in the App Store applies; price and currency can vary by region and change over time. Management and cancellation are handled through your Apple ID settings or the App Store. Purchases can be restored through StoreKit. Refunds are subject to Apple's process and statutory rights; Tommsel does not offer a separate refund guarantee.

6. Availability

Tommsel strives for reliable operation of Voxavo but does not guarantee uninterrupted technical availability, particularly with regard to system requirements, iOS versions, and device compatibility.

7. Intellectual property

The content, design, and software of Voxavo are protected by copyright. Use beyond the intended personal use is not permitted without consent.

8. Liability

Tommsel is fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law requires it. For a slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer rights remain unaffected.

9. Availability and changes

Features may be developed, changed, or discontinued where legally permitted and with due regard to users' legitimate interests.
