Terms of Use for WakeGate
1. Scope
These Terms of Use apply to the WakeGate iPhone app by Tom Silas Helmke. Mandatory consumer rights remain unaffected.
2. App functionality
WakeGate is a locally oriented alarm app with alarms, snooze, Wake Missions, exercise and NFC missions, history, and system integrations. It is not a medical product, therapy, fitness diagnosis, emergency alert service, or safety-critical alarm system.
3. Requirements and AlarmKit
WakeGate requires a compatible Apple device and the conditions provided by iOS. Alarms are scheduled through Apple’s AlarmKit and system alarm infrastructure. WakeGate cannot remove or block Apple’s system stop. After the system stop, it can open a Wake Mission; iOS decides unlocking and foreground presentation on locked devices. WakeGate does not guarantee a wake-up result or alarm delivery under every device and system condition.
4. Wake Missions
Exercise Missions are solely a getting-up task. The camera is used only for this purpose; it is not used to identify people or provide medical analysis. NFC Missions use compatible tags. You are responsible for ensuring that you are entitled to overwrite third-party content. WakeGate asks for confirmation before overwriting a writable tag.
5. Free and WakeGate Pro
The Free version permits up to three active alarm profiles. All core Wake Challenges remain Free. WakeGate Pro enables unlimited active alarm profiles.
6. Subscriptions and payments
WakeGate Pro may be offered as a monthly or annual auto-renewing subscription. Payment and automatic renewal are handled through your Apple ID under App Store terms. Apple displays the current price and currency, which can vary by region. Purchases can be restored through StoreKit. Management and cancellation are handled through Apple. Refunds are subject to Apple’s process and statutory rights; Tommsel does not offer a separate refund guarantee.
7. Availability and changes
Features may be developed, changed, or discontinued where legally permitted and with due regard to users’ legitimate interests.
8. Liability
Tommsel is fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law requires it. For a slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer rights remain unaffected.
