Terms of Use for Cyleniva
1. Scope
These Terms of Use apply to the Cyleniva iPhone app by Tom Silas Helmke. Cyleniva is in development. They supplement the product specific information on this website. Mandatory consumer rights remain unaffected.
2. Description of the service
Cyleniva is a personal journal for cycle, bleeding, symptoms, contraception, medication, and daily entries on iPhone. The app documents your entries, provides calendar, history, insights, PDF reports, data export, encrypted backups, local reminders, and widgets, and offers additional features with Pro.
3. Personal tracking, no medical service
Cyleniva is for personal tracking. The app makes no diagnosis, gives no treatment recommendation, does not assess the reliability of contraception, and does not replace medical or therapeutic advice. Insights describe only what you entered and name no causes. For health questions or complaints, contact a medical professional.
4. Reminders
Reminders and check ins are local iOS notifications. iOS controls their delivery, and it depends on settings, Focus modes, and system state, among other things. Timely delivery or delivery to the exact second is not guaranteed. Do not rely on a reminder alone for important intakes.
5. Your responsibility
You are responsible for the accuracy and completeness of your entries and decide which details you record and share. Protect your device, for example with a device passcode, so that third parties cannot access your entries.
6. Local data storage
Your entries, templates, and settings are stored locally on your device. Cyleniva offers no user account service and no proprietary cloud sync. If the device is lost or the app is removed, the data can be lost when no backup exists.
7. Backups, restore, and exports
You can create and restore encrypted manual backups, export data as JSON or CSV, and export reports as PDF. You are responsible for creating backups regularly, keeping the details needed for restore safe, and protecting exported files. Exported files can be unencrypted. The export is created locally and only shared or saved through iOS on your action.
8. Free feature set
Free includes unlimited bleeding and symptom tracking, contraception and medication tracking, local reminders, the complete calendar and history, stress, sleep, and everyday observations, basic statistics, simple charts, standard PDF reports, the complete JSON and CSV original data export, encrypted backup and restore, standard widgets, up to three new simple templates, and four regular quick actions.
9. Pro feature set
Pro adds unlimited templates, up to six quick actions, a customisable Today page, custom comparison periods, extended chart types, custom report categories, and saved report profiles. The feature set can change as the app develops. Access to your own data and the data export are not behind Pro.
10. Monthly and yearly subscription
Cyleniva Pro is intended as Monthly (1 month) and Yearly (1 year). Both are auto renewing Apple subscriptions. Payment is made through your Apple ID. The subscription renews automatically for the same period unless it is cancelled through Apple at least 24 hours before the end of the current period. You manage and cancel it in your Apple ID settings under Subscriptions.
11. Lifetime
Lifetime is a one time purchase without automatic renewal and unlocks Cyleniva Pro permanently for the Apple ID it was purchased with. Permanently refers to the lifetime of the app in the form in which it is offered.
12. Prices and restoring purchases
Planned German reference prices are €2.49 per month, €17.99 per year, and €39.99 one time. These are planned prices because Cyleniva is not released yet. The price Apple later shows in the App Store before purchase applies, including the currency. It can differ by country or region. You can restore purchases in the app through restore with the Apple ID used.
13. Withdrawal, refunds, and consumer rights
Purchases are processed through Apple. Refunds are handled under Apple's procedure and statutory consumer rights. Mandatory statutory rights, including any right of withdrawal under the applicable conditions, remain unaffected. Tommsel gives no refund guarantee of its own.
14. Technical availability
Cyleniva requires a compatible iPhone and a supported iOS version. Individual features, such as notifications, widgets, or the Apple Health import, can be available differently depending on device, iOS version, permissions, and system state. Uninterrupted availability is not promised.
15. Liability
Tommsel is liable without limitation for intent, gross negligence, injury to life, body, or health, and where mandatory law requires. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer rights remain unaffected.
16. Changes to the terms
These terms can be updated, for example for new features or changed legal requirements. You find the current version on this page.
17. Apple's standard license agreement
In addition to these Terms of Use, Apple's Standard EULA (Licensed Application End User License Agreement) applies to obtaining Cyleniva through the App Store. Cyleniva does not use its own, different license agreement.
