Terms of Use for JotCue
1. Scope
These Terms of Use apply to the JotCue iPhone app by Tom Silas Helmke. Mandatory consumer rights remain unaffected.
2. Description of the service
JotCue is a locally oriented iPhone app for quickly capturing voice and text input. Captured content can be organized as a note or task, assigned to projects and threads, and supplemented with photos or links. JotCue is not a medical product, not a dictation device for professional transcription services, and not a replacement for a dedicated reminder or calendar system.
3. System requirements
JotCue requires a compatible iPhone and the conditions provided by iOS. Individual features such as local transcription, Action Button, Live Activities, widgets, or shortcuts are only available on supported devices and iOS versions and can vary depending on device and system state. Continued compatibility with all future devices or iOS versions is not guaranteed.
4. Local data storage and backups
Notes, tasks, projects, threads, attachments, and settings are stored locally on your device. JotCue offers a local, versioned backup format (.jotcuebackup) and a restore function. You are responsible for creating, keeping, and restoring your own backups; JotCue does not operate its own cloud backup service.
5. Speech recognition
Local transcription uses supported Apple speech technologies. Speech recognition can contain errors, misrecognize words, or be unavailable in certain situations. JotCue does not warrant complete or error-free recognition of spoken content.
6. System features and limitations
Action Button, Live Activities, widgets, Control Center controls, and app shortcuts are provided through iOS system interfaces. The availability and behavior of these features depend on the specific device, iOS version, and lock/system state and can vary. JotCue does not guarantee that a feature will start under every locked or background condition.
7. Free and JotCue Pro
Free includes, among other things, unlimited voice and text capture, inbox, notes, tasks, local transcription, and one active project and one active thread. JotCue Pro unlocks, among other things, unlimited projects, unlimited threads, and advanced organization features. The feature scope of Free and Pro may change with future app versions.
8. Subscriptions and payments
JotCue Pro may be offered as a monthly or annual auto-renewing subscription as well as a one-time Lifetime purchase (non-consumable). Payment and automatic renewal are handled through your Apple ID under App Store terms. The price shown in the App Store at the time of purchase applies; price and currency can vary by region and change over time. Purchases can be restored through StoreKit. Subscription management and cancellation are handled through Apple. Refunds are subject to Apple’s process and statutory rights; Tommsel does not offer a separate refund guarantee.
9. Availability and changes
Features may be developed, changed, or discontinued where legally permitted and with due regard to users’ legitimate interests.
10. Liability
Tommsel is fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law requires it. For a slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded, in particular for data loss where you have not kept your own backups. Mandatory consumer rights remain unaffected.
