Terms of Use for Keyvessa

1. Scope and provider

These terms apply to the use of the Keyvessa iPhone app. The provider is Tom Silas Helmke, c/o Online-Impressum #4746, Europaring 90, 53757 Sankt Augustin, Germany. Keyvessa is in development and not yet available on the App Store. These terms are an editorial draft for the current state of development and will be reviewed before release.

2. Purpose of the app

Keyvessa is a private, locally encrypted library for personal photos, videos and files on the iPhone. The app is intended for personal use.

3. Local use

Keyvessa works without a user account. Your content is processed locally on your device and is not transmitted to Tommsel servers. You remain the owner of your content and are responsible for being allowed to use it lawfully.

4. Responsibility for recovery information

Recovery information is generated locally. Tommsel holds no copy and cannot restore lost recovery information. You are responsible for storing your recovery set safely and not passing it to unauthorized people. Whoever gains access to it may be able to gain access to your vault.

5. Responsibility for exported content

When you export content or share it through the iOS share sheet, the exported copies leave the protected area of Keyvessa. The terms of the location or service you choose apply to them. You are responsible for the sharing.

6. Data loss and device dependence

Keyvessa cannot prevent every conceivable data loss. Data loss can occur, for example, through device failure, loss of the device, deleting the app or lost recovery information. The app depends on functions and settings of your device and on iOS.

7. Intellectual property

The app, its design and its texts are protected by copyright and belong to the provider, unless third party rights exist. Your own content stays with you.

8. Availability and changes

Features can change before and after release. Uninterrupted availability cannot be promised. These terms will be updated if the app or its distribution model changes.

9. Statutory rights and liability

Statutory rights, in particular mandatory consumer rights, remain unaffected. The provider is liable in accordance with the statutory provisions, in particular for intent, gross negligence, injury to life, body and health, and breach of essential contractual obligations. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage, to the extent permitted by law.

10. Apple standard license agreement

In addition to these terms, Apple's Standard EULA, the Licensed Application End User License Agreement, applies to obtaining the app through the App Store. Keyvessa does not use a different license agreement of its own.

11. Contact

Send questions about Keyvessa to tshfm78@gmail.com. Please do not send recovery information, QR codes or private content by email unprompted.
