Terms of Use for Lovikora
1. Provider and scope
These Terms of Use apply to the Lovikora iPhone app by Tom Silas Helmke. Lovikora is in development. They supplement the product specific information on this website. Mandatory consumer rights remain unaffected.
2. Function of the app
Lovikora is a personal heart clicker with heart profiles, heartbeats, thoughts, love sparks, upgrades, streaks, statistics, achievements, heart styles, a Heart Studio, click sounds, memory cards, widgets, and local backup. The app is an entertainment product and not a messaging or dating app.
3. Free and Pro
Free includes unlimited real heartbeats, basic heart profiles, thoughts, love sparks, upgrades, daily streaks, statistics, achievements, hearts you can unlock for free, basic sounds, simple cards, free complete backups, restore, and the preview in the Heart Studio. Pro adds additional premium hearts, permanent saving of your own hearts, extended materials, special particles and auras, additional animations, the Sound Studio, importing your own click sounds, and extended profile and card options. The feature set can change as the app develops.
4. One time Lifetime purchase, no subscription
Lovikora Pro is intended as a one time Lifetime purchase through Apple StoreKit. There is no subscription and no automatic renewal. Apple shows the price in the App Store before purchase, including the currency. It can differ by country or region. Lifetime refers to the lifetime of the app in the form in which it is offered.
5. Restoring purchases, refunds, and consumer rights
You can restore purchases in the app through restore with the Apple ID used. Purchases are processed through Apple, and refunds are handled under Apple's procedure and statutory consumer rights. Mandatory statutory rights, including any right of withdrawal under the applicable conditions, remain unaffected. Tommsel gives no refund guarantee of its own.
6. Virtual love sparks
Love sparks are a virtual in game currency with no monetary value. They cannot be paid out, transferred, or converted into real money or other value. There is no entitlement to a particular game state or reward.
7. Your own photos, audio files, and content
You are responsible for using only photos, audio files, and texts you have the necessary rights to and for respecting the personal rights of people shown. Imported content is stored locally. You grant Tommsel no rights to it.
8. Personal cards and sharing
Memory cards are created locally and only shared or saved through iOS on your action. You are responsible for cards you pass on and the rights to them. The “Thinking of you” feature sends no message to other people.
9. Local data storage and backups
Your content is stored locally on your device. Lovikora offers no user account service and no proprietary cloud sync. You are responsible for creating backups regularly. At the current status, backup files are not password encrypted. Store them safely and share them only with trusted recipients. If the device is lost or the app is removed, data can be lost without a backup.
10. Widgets, haptics, and system dependencies
Widgets, haptics, notifications, and sound depend on device, iOS version, settings, and system state. An immediate widget update and a particular haptic response are not promised.
11. Availability and updates
Lovikora requires a compatible iPhone. Features can be developed further, adapted, or discontinued as far as legally permitted and taking users' legitimate interests into account. Uninterrupted availability is not promised.
12. Liability
Tommsel is liable without limitation for intent, gross negligence, injury to life, body, or health, and where mandatory law requires. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer rights remain unaffected.
13. Changes to the terms
These terms can be updated, for example for new features or changed legal requirements. You find the current version on this page.
14. Apple's standard license agreement
In addition to these Terms of Use, Apple's Standard EULA (Licensed Application End User License Agreement) applies to obtaining Lovikora through the App Store. Lovikora does not use its own, different license agreement.
