Terms of Use for Mentelys
1. Scope
These Terms of Use apply to the Mentelys iPhone app by Tom Silas Helmke. Mandatory consumer rights remain unaffected.
2. Description of the service
Mentelys is a locally oriented iPhone app for cognitive training and personal progress tracking with six training areas, twelve adaptive training exercises, six checkpoints, and Personal Recall. Mentelys is not a medical product, does not provide a diagnosis, and is not an IQ test. There is no guarantee of specific cognitive effects or improved everyday performance.
3. Training results and Personal Recall
Training Level, Training Balance, Checkpoint Trends, Streak, Engagement XP, Engagement Level, and Achievements are app-internal values and are not a statement about intelligence or cognitive ability. You are responsible for content you enter yourself through Personal Recall.
4. Local data storage and backups
Training data, progress, and Personal Recall content are stored locally on your device. Mentelys offers a local backup and restore export. You are responsible for creating, keeping, and restoring your own backups; Mentelys does not operate its own cloud backup service. A backup may contain Personal Recall content.
5. Free and one-time Full Unlock
Free is a genuinely usable base version. Full Unlock unlocks the full feature set through a one-time purchase (non-consumable); it is not a subscription.
6. Purchase and payment
The Full Unlock purchase is processed through Apple's App Store and StoreKit. The price shown in the App Store at the time of purchase applies. Purchases can be restored through StoreKit. Refunds are subject to Apple's process and statutory rights; Tommsel does not offer a separate refund guarantee.
7. System requirements and availability
Mentelys requires a compatible iPhone. Individual features may be available differently depending on device, iOS version, and system state. Features may be developed, changed, or discontinued where legally permitted and with due regard to users' legitimate interests.
8. Liability
Tommsel is fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law requires it. For a slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded, in particular for data loss where you have not kept your own backups. Mandatory consumer rights remain unaffected.
9. Apple's standard license agreement
In addition to these Terms of Use, Apple's Standard EULA (Licensed Application End User License Agreement) applies to obtaining Mentelys through the App Store. Mentelys does not use its own, different license agreement.
