Terms of Use for Puckivo
1. Provider and scope
These terms apply to the use of the Puckivo app for iPhone and iPad. The provider is Tom Silas Helmke, c/o Online-Impressum #4746, Europaring 90, 53757 Sankt Augustin, Germany. Puckivo is in development and not yet available on the App Store. This text is an editorial draft for the current state of development and will be reviewed legally before release.
2. Purpose of the app
Puckivo is an air hockey and arcade game and serves entertainment. The app is intended for personal use on supported Apple devices.
3. Game results
There is no entitlement to particular results against bots or to particular courses of play. Difficulty levels, bot personalities, missions, and medals are part of the game and can change before and after release.
4. Local progress
Progress, medals, unlocks, settings, and your own arenas are stored locally on your device. They can be lost, for example through device failure, loss of the device, or deleting the app. Restoring them is not promised.
5. Your own arenas and challenges
You are responsible for arenas and challenges you create yourself. They stay local on your device. Puckivo does not host your arenas online and offers no upload or community platform.
6. No subscription, planned Full Game Unlock
Puckivo has no subscription. An optional one-time Full Game Unlock as an App Store purchase is planned. It is not available at the moment. Special prestige and mastery rewards remain playable to earn.
7. Purchase, payment, and restoring
Once the Full Game Unlock is offered, purchase, payment, and restoring are handled through Apple. The price shown in the App Store before purchase applies, and it can vary by region. Refunds follow Apple's procedures and statutory rights. Tommsel gives no refund guarantee of its own.
8. Availability and changes
Puckivo requires a supported iPhone or iPad. Features can be available differently depending on the device, iOS version, and system state. Uninterrupted or error-free use cannot be promised. Features may be developed, changed, or discontinued where legally permitted and with due regard to users' legitimate interests.
9. Rights to software and content
The app, its design, and its texts are protected by copyright and belong to the provider, unless third party rights exist. Your own arenas stay with you.
10. Statutory rights and liability
Statutory rights, in particular mandatory consumer rights, remain unaffected. The provider is liable in accordance with the statutory provisions, in particular for intent, gross negligence, injury to life, body and health, and breach of essential contractual obligations. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage, to the extent permitted by law. Otherwise liability for slight negligence is excluded, in particular for loss of local data, to the extent permitted by law.
11. Apple standard license agreement
In addition to these terms, Apple's Standard EULA, the Licensed Application End User License Agreement, applies to obtaining the app through the App Store. Puckivo does not use a different license agreement of its own.
