Privacy Policy for Binavelle

This policy describes processing by the Binavelle app, a local audio studio for binaural sessions on iPhone. It describes Binavelle and not the website. Visiting tommsel.com itself, including hosting, server logs, and website services, is governed by the general tommsel.com privacy policy.

Binavelle is in development. This policy describes the current product status and will be checked against the final state of the app before release.

Binavelle is locally oriented. The app uses no user account, no custom backend, no custom server database, and no custom cloud sync. Audio is generated and mixed on your device.

Binavelle stores on your device, among other things: sessions, session stages, presets, app settings, the sleep schedule, and playback checkpoints. Binavelle does not send this data off your device.

You choose audio files yourself through the iOS file picker. The files are imported locally into the Binavelle audio library. There is no upload to Tommsel.

If you choose a file through iCloud Drive or a third party file provider, the respective system service can provide the file. Binavelle does not transmit it to a server of its own. Processing by those services is governed by their own privacy information.

To display audio files, Binavelle can create a waveform cache and other local working data. This data is stored and processed locally on the device.

M4A and WAV files are created locally on your device. Sharing or saving through the share sheet or in Files only happens on your explicit action through iOS. You decide where an exported file goes.

The sleep schedule uses local notifications that are scheduled directly on your device. iOS asks for your permission, which you can change at any time in iOS Settings. Tommsel operates no push infrastructure for this.

Background playback, Lock Screen Now Playing, and Control Center are iOS system integrations. They are provided on your device by iOS. There is no server processing by Binavelle or Tommsel.

Purchase and payment for Binavelle Pro (Monthly, Yearly, and Lifetime) take place through Apple. Binavelle uses StoreKit entitlements to determine the Pro status. Binavelle operates no payment database of its own and receives no payment data such as card numbers. Processing by Apple is governed by Apple's own privacy information and is not covered by this policy.

Binavelle uses no analytics, no advertising, and no tracking.

Binavelle does not upload audio files, sessions, or exports to Tommsel or to a server of its own.

At the current development status, Binavelle uses the iOS permission for local notifications if you use the sleep schedule. Importing through the iOS file picker requires no blanket permission for your files: Binavelle only receives the files you select.

You can delete local data through the app's functions and, where applicable, by removing the app from your device. Available iOS options can differ.

Imported and exported files outside the app container remain under your control or that of the chosen file provider. Device backups remain independently.

Data processing when visiting tommsel.com, including hosting and server logs, is described in the general tommsel.com privacy policy and is not covered by this app specific policy.

Where the legal requirements are met, you have rights of access, rectification, erasure, restriction of processing, data portability, and objection. You can contact tshfm78@gmail.com and have the right to lodge a complaint with a data protection supervisory authority.
