Terms of Use for Ownplora

1. Provider and scope

These terms apply to the use of the Ownplora app for iPhone and iPad. The provider is Tom Silas Helmke, c/o Online-Impressum #4746, Europaring 90, 53757 Sankt Augustin, Germany. Ownplora is in development and not yet available on the App Store. This text is a professionally prepared draft and must be reviewed legally before it becomes binding.

2. Purpose and scope of functions

With Ownplora you can record personal observations, capture measurements and evaluate your records. The final scope of functions will only be settled at release.

3. Personal use

The app is intended for your personal use. You remain the owner of your records and are responsible for what you enter and pass on.

4. Limits of evaluations

Evaluations describe the data you entered yourself. They can show patterns and changes but do not automatically prove cause and effect. The quality of an evaluation depends on the amount and accuracy of your entries. An evaluation is not a clinical assessment.

5. No medical advice

Ownplora makes no diagnoses, gives no treatment recommendations and does not replace a medical examination, advice or treatment. If you have health complaints, contact medical professionals. Do not make medical decisions solely on the basis of the app.

6. Responsibility for your own experiments

If you observe changes to nutrition, exercise, sleep or other habits, you decide on and are responsible for those changes yourself. Talk to medical professionals beforehand about health questions.

7. Importing external study templates

External study templates come from third parties and are not automatically scientifically or professionally reviewed. You are responsible for checking the source of a template before you use it.

8. Export and sharing of personal data

You trigger exports, reports and backups yourself. Exported files can contain sensitive information, and certain exports are unencrypted. When you pass files on, recipients process them on their own responsibility under their own terms. Keep backups and any related access information safe.

9. Technical availability

The app depends on functions of your device and on iOS, for example for notifications, widgets and Apple Health. Data loss can occur, for example, through device failure or deleting the app. Therefore back up your data regularly with a backup. Uninterrupted availability cannot be promised.

10. Rights to software and content

The app, its design and its texts are protected by copyright and belong to the provider, unless third party rights exist. Your own records stay with you.

11. Statutory rights and liability

Statutory rights, in particular mandatory consumer rights, remain unaffected. The provider is liable in accordance with the statutory provisions, in particular for intent, gross negligence, injury to life, body and health, and breach of essential contractual obligations. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage, to the extent permitted by law.

12. Changes and monetization

No purchase model is currently settled for Ownplora, and these terms describe no subscriptions or prices. If that changes, the terms will be updated.

13. Apple standard license agreement

In addition to these terms, Apple's Standard EULA, the Licensed Application End User License Agreement, applies to obtaining the app through the App Store. Ownplora does not use a different license agreement of its own.

14. Support and contact

Send questions about Ownplora to tshfm78@gmail.com. Please do not send health data or personal records by email unprompted.
