Terms of Use for Priovue
1. Scope
These Terms of Use apply to the Priovue iPhone app by Tom Silas Helmke. Priovue is in development and not yet available on the App Store. Functions and offers described here that are not implemented yet are planned. Mandatory consumer rights remain unaffected.
2. Using Priovue
Priovue is an organization tool for capturing, prioritizing and connecting ideas, tasks, projects, goals and identities. You use the app for your personal purposes within these terms and the applicable laws.
3. Responsibility for your own content and organization
You are responsible for the content you capture in Priovue and for your decisions. Priovue does not guarantee that you reach goals, that priorities are objectively right, or that progress values are an objective assessment. Reminders are delivered through iOS and are not guaranteed to trigger under all system states. Do not rely on the app alone for important appointments.
4. Local data storage
Your content is stored locally on your device by default. Priovue offers no user account and no backend of its own for user data. If the device is lost or the app is removed, data can be lost without a backup.
5. Backups and exports
Backup, restore and export are planned for Free. You are responsible for creating backups regularly and storing them safely. Backups and exports can contain personal content. You are responsible for files you pass on to other services or people. No special encryption is promised.
6. Optional iCloud sync
Optional sync through Apple iCloud between your own Apple devices is planned. It is a service of Apple that you activate yourself, and Apple's terms apply in addition. There is no Tommsel account and no Tommsel sync backend. Apple is responsible for the availability and function of Apple's system services.
7. Free and Pro
Free is planned as a permanently usable base version, for example with basic capture, local voice input, inbox, priorities, basic reminders, backup and restore, and basic exports. Pro mainly adds depth and power user features, such as unlimited projects, goals and identities, extended graph relations, weighted progress calculation, extended visualization, configurable widgets, local AI assistance, extended statistics and reports. Access to your own data is not artificially locked. The exact scope can change before release.
8. Pro annual subscription
A Pro annual subscription at a price of €19.99 per year is planned. It would be an auto-renewing subscription through Apple StoreKit. There is no weekly subscription. This offer cannot be purchased yet. The price Apple shows in the App Store before purchase, including the currency, is what applies. It can differ by country or region.
9. Pro Lifetime
A one time Pro Lifetime purchase at a price of €69.99 is planned. A price of €49.99 is intended at launch. This offer cannot be purchased yet either, and the price shown in the App Store applies. Lifetime refers to the lifetime of the app in the form in which it is offered.
10. Purchase and payment through StoreKit
Purchases and subscriptions are processed through Apple StoreKit and your Apple ID under App Store terms. Priovue does not process payment data itself. There is no artificial trial, and there are no coins or AI credits.
11. Restoring purchases
You can restore purchases in the app through restore with the Apple ID used. This can require an internet connection.
12. Cancelling and managing the annual subscription through Apple
You manage and cancel an annual subscription through your Apple ID settings or the App Store. Cancellations must be made before the current period ends under Apple's rules. Deleting the app does not end a subscription.
13. Statutory consumer rights
Mandatory statutory rights, including any right of withdrawal under the applicable conditions, remain unaffected. Refunds are handled under Apple's procedure and statutory consumer rights. Tommsel gives no refund guarantee of its own.
14. System requirements and availability of functions
Priovue requires a compatible iPhone and a supported iOS version. Functions such as the Action button, widgets, local speech recognition and local AI depend on device, iOS version, language and settings and are not available on every device. AI suggestions, if present, are aids and not binding decisions and can be wrong. Features can be developed further, adapted or discontinued as far as legally permitted and taking users' legitimate interests into account. Uninterrupted availability is not promised.
15. Liability
Tommsel is liable without limitation for intent, gross negligence, injury to life, body or health, and where mandatory law requires. For slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer rights remain unaffected.
16. Apple's standard license agreement
In addition to these Terms of Use, Apple's Standard EULA (Licensed Application End User License Agreement) applies to obtaining Priovue through the App Store. Priovue does not use its own, different license agreement.
