Terms of Use for Temiqo
1. Scope
These Terms of Use apply to the Temiqo iPhone app by Tom Silas Helmke. Temiqo is in development. Mandatory consumer rights remain unaffected.
2. Description of the service
Temiqo is a local iPhone app for GPS speed, performance measurements, track timing, a flight display for passengers, saved runs, export, backup, and feedback. The scope of the Free version and of Temiqo Pro is described on the project page. No particular measurement results or performance are promised.
3. GPS measurement and limits
GPS measurements can be affected by the device, satellite visibility, surroundings, reflections, tunnels, buildings, system state, and other technical factors. No guarantee is given for a particular accuracy. Temiqo shows quality information where available.
4. No certified timing
Temiqo is not a certified or official race timing system. Results are not automatically suitable for official competitions, homologated records, or legally relevant measurements.
5. Safety
Configure Temiqo before you start moving and do not interact with the iPhone while driving. Use performance and track features only where this is safe and legally permitted. Temiqo is not a street racing app and does not encourage speeding or using public roads for performance tests. You are responsible for your own conduct.
6. Flight
Flight mode serves informational purposes for passengers only. Temiqo is not a navigation instrument, not a flight instrument, not an airspeed indicator for flight operations, not an altimeter for operational aviation, and not an emergency system. GPS altitude can differ from the figures given on the aircraft.
7. System dependencies
Temiqo partly depends on iOS frameworks and device features such as location services. There is no guarantee that every feature works identically on every piece of hardware or in every system state. Temiqo requires a compatible iPhone.
8. Free and Temiqo Pro
Temiqo Free is free and has no ads. Temiqo Pro unlocks advanced features, including advanced performance, advanced analysis, Track Pro, advanced exports, encrypted backups, and more share card options. Export All My Data, local backup, and restore stay in Free.
9. Purchase through Apple
Temiqo Pro is a one time lifetime purchase (non consumable) through Apple StoreKit and not a subscription. Apple shows price and currency before purchase. Payment, purchase terms, and possible refunds are handled by Apple within the App Store. Purchases can be restored through Apple or StoreKit. Temiqo does not process credit card data, and Tommsel gives no refund guarantee of its own.
10. Local data
Your measurement data, tracks, and settings are stored locally on your device. Temiqo offers no cloud service of its own. You are responsible for creating and keeping your backups.
11. Export and sharing
If you export or share data, you are responsible for handling the export files securely. Temiqo does not control external destination providers after your deliberate release.
12. Availability and changes
Features may be developed, changed, or discontinued where legally permitted and with due regard to users' legitimate interests.
13. Liability
Tommsel is fully liable for intent, gross negligence, injury to life, body, or health, and where mandatory law requires it. For a slightly negligent breach of essential contractual duties, liability is limited to foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded. Mandatory consumer rights remain unaffected.
14. Apple's standard license agreement
In addition to these Terms of Use, Apple's Standard EULA (Licensed Application End User License Agreement) applies to obtaining Temiqo through the App Store. Temiqo does not use its own, different license agreement.
