Terms of Use for Pourniva
1. Provider and scope
These terms apply to the use of the native Pourniva app for iPhone and iPad. The provider is Tom Silas Helmke, c/o Online-Impressum #4746, Europaring 90, 53757 Sankt Augustin, Germany. Pourniva is in development and not yet available on the App Store. This text is an editorial draft for the current state of development and will be reviewed legally before release.
2. Function of the app
Pourniva serves to organize cocktails, mocktails and drinks, to display recipes, to support mixing and to store personal content locally on your device. The app is intended for personal use.
3. Recipe information
Recipes and knowledge content serve information and practical use. It is not promised that every historical or regional variant of a recipe is defined identically worldwide.
4. Personal versions and user content
You can save your own recipes, versions, texts, photos and tips. They stay local on your device. You remain the owner of your content. If you share content, you must hold the rights required for it. Imported recipes are not automatically curated or verified Pourniva recipes.
5. Allergies and ingredients
Pourniva is not an allergy checker and gives no medical advice. Check ingredients, product labels, allergens and personal intolerances yourself.
6. Alcohol
Pourniva does not encourage alcohol consumption. Alcohol-free drinks are part of the app. Observe the age, traffic and alcohol laws that apply to you.
7. Alcohol and energy estimates
Figures for pure alcohol and for energy from alcohol are local estimates based on available ingredient information and your input, including your own ABV values. They are not exact values and do not take all ingredients fully into account. Do not use them for medical, nutritional or legal decisions, or to judge whether you are fit to drive. Pourniva deliberately does not calculate a blood alcohol value at present.
8. Sharing, export and import
You decide whether and where you send share cards or .drinkrecipe files through the iOS share sheet. The destination you choose has its own terms. For imported files, you are responsible for checking the source.
9. Local data and data loss
Your content is stored locally on your device. It can be lost, for example through device failure, loss of the device or deleting the app. Restoring it is not promised.
10. Availability and changes
Features can be available differently depending on the device, iOS version and system state. Uninterrupted or error-free use cannot be promised. Features can change before and after release.
11. Purchases and monetization
No purchase model is currently settled for Pourniva, and these terms describe no prices or subscriptions. If that changes, the terms will be updated.
12. Rights to software and content
The app, its design and its texts are protected by copyright and belong to the provider, unless third party rights exist. Your own content stays with you.
13. Statutory rights and liability
Statutory rights, in particular mandatory consumer rights, remain unaffected. The provider is liable in accordance with the statutory provisions, in particular for intent, gross negligence, injury to life, body and health, and breach of essential contractual obligations. In the case of slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable, typical damage, to the extent permitted by law. Otherwise liability for slight negligence is excluded, in particular for loss of local data, to the extent permitted by law.
14. Apple standard license agreement
In addition to these terms, Apple's Standard EULA, the Licensed Application End User License Agreement, applies to obtaining the app through the App Store. Pourniva does not use a different license agreement of its own.
